THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.28147 of 2019 ORDER:
The present writ petition is filed to declare the action of the respondents 2 to 6 in interfering with the rights of the petitioner with respect to the plot No.123/A admeasuring 320 square yards in Survey No.321 of Sri Ramachandra Nagar, situated at Rajendranagar, Gajularamaram, Abdullapurmet Mandal, Medchal District, as being illegal, arbitrary and unconstitutional.
Heard Sri N. Naveen Kumar, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the official respondents and Sri K. Malleswar Rao, learned counsel for the unofficial respondents 7 & 8.
Counter affidavit on behalf of the 5th respondent-Station House Officer, Jagadgirigutta Police Station is filed. With reference to the alleged interference by the respondent authorities in civil disputes, more particularly with respect to the petitioner's right over the subject plot being interfered by the police authority, in paragraph-7 of the said counter it is stated as under:
"It is respectfully submitted that the Respondent Police never interfered into the civil disputes as the matter of the above property is pending before the Competent Civil Court. The Respodnent Police discharging their legitimate duties by following due procedure contemplated under Law."
Having regard to the said categorical statement made on behalf of the respondent police that the said authorities are not interfering into the civil disputes, as the matter is pending before the competent civil Court, it is expected of the respondent police authorities to keep their hands off in respect of the civil disputes pending between the petitioner and the unofficial respondents, except investigating into any crime that is registered against the parties in accordance with law.
Subject to the above observation, the writ petition is closed. No order as to costs. Pending miscellaneous petitions, if any, pending in this writ petition shall stand closed, in the light of this final order.
