HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.4076 of 2017 ORDER:

In this petition filed under Section 438 Cr.P.C, the petitioner/A.1 seeks pre-arrest bail in Crime No.23 of 2017 of Ongole Women PS, Prakasham District which was registered against the petitioner and other accused for the offences under Sec.498-A IPC and Sec.3 & 4 of Dowry Prohibition Act.

2) The petitioner/A.1 is the husband of the defacto complainant. The main accusation is that since few days after the marriage between the petitioner and complainant which was held on 15.04.2015, all the accused started harassing the petitioner physically and mentally for 21⁄2 Acres of land which was agreed to be given to them by the parents of the complainant. Having regard to the prima facie nature of accusation against the petitioner/A.1 and pending investigation, it is not a fit case to grant anticipatory bail.

3) While dismissing the petition, the petitioner/A.1 is directed to surrender before concerned Court and seek for regular bail, in which case the learned Magistrate shall dispose of his bail application on merits on the same day.
