THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.19678 OF 2017 DATED : 19.06.2017 Between :
Sompalli Hema Shankar S/o.S.Narayana, Age 59 yrs, Occu : Assistant Registrar, Special Commissioner for Co-operation And Registrar of Cooperative Societies, Shyamala Nagar, Guntur, Andhra Pradesh State. ..
Petitioner And The State of Andhra Pradesh, Rep., by its Principal Secretary, Co-operative Department, Secretariat Buildings, Velagapudi, Guntur District & others.
.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.19678 OF 2017 ORDER :
Heard.
2.
Petitioner challenges the order dated 02.01.2017 of the Special Commissioner for Co-operation and Registrar of Cooperative Societies, Guntur, informing the petitioner that in view of the orders passed in I.A.No.36 of 2015 in O.S.No.6 of 2015 and some other orders as shown in the reference 2nd cited in the impugned proceedings, the request for GPF part final withdrawal cannot be permitted as it would be amounting to violating the orders of the Court.
3.
It is not in dispute that orders are passed by the trial Courts in various cases which are enclosed to the affidavit filed in support of the writ petition and these orders are in force. Petitioner is informed that in view of the orders of the competent Court he cannot be permitted to withdraw the amount.
4.
Having regard to the fact that the competent Courts have granted orders directing withholding of the retirement benefits including GPF part final withdrawal, I do not see any illegality in the communication given to the petitioner warranting interference by this Court and the writ petition deserves no consideration. 5.
Accordingly, the Writ Petition is dismissed leaving it open to the petitioner to work out his remedies as available in law. There shall be no order as to costs.
- 3 - Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
