Heard Sri Chalakani Venkat Yadav, learned counsel for the Petitioner and the learned Government Pleader for Panchayatraj for the State of Telangana appearing for the respondents. The Show Cause Notice bearing No.712/ 2018-A (Pan) dt. 18.04.2018 issued by the District Collector (Panchayatraj Wing), Yadadri Bhuvanagiri District under Section 249(1) of the Telangana State Panchayat Raj Act, 1994, is challenged in the present Writ Petition. By way of the said Show Cause Notice, the District Collector asked the petitioner to show cause as to why he should not be removed from the office of Sarpanch and granted 15 days time to submit the explanation to the said show cause notice.

It is submitted by the learned counsel for the petitioner that without supplying the copy of the Report submitted by the Extension Officer, Panchayat, dt. 28.03.2018, the Show Cause Notice came to be issued by the District Collector. On the other hand, the learned Government Pleader submitted that the Notice impugned in the present Writ Petition is only a show cause notice and there is no decision taken by the respondent authorities and if the report of the Extension Officer is taken into consideration, it is open for the petitioner herein to challenge the same. It is also submitted that the power of the

District Collector is not under challenge in the present Writ Petition and it is open for the petitioner herein to submit his explanation.

Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court, in the present facts and circumstances of the case, deems it appropriate to dispose of the Writ Petition, keeping it open for the petitioner herein to submit his explanation within a period for four weeks from today. If any such explanation is filed by the petitioner herein, the same shall be considered and appropriate orders be passed in accordance with law.

With the above directions, this Writ Petition is disposed of. As a sequel, the miscellaneous petitions, if any, pending shall stand closed.
