CVNR,J & MSKJ,J WP.8049 of 2017 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.8049 of 2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for the following substantive relief: "...to issue an order or direction more particularly one in the nature of Writ of Habeas Corpus, directing the respondents to produce the detenu, by name, Uyyala Chanti, S/o.late Ranganna, Hindu, aged 24, years, Occ:Agrl.Cooli, R/o.Stuvartpuram village, Bapatla Mandal, Guntur District, Andhra Pradesh, before this Honourable Court and be released from custody." Respondent No.
4 filed counter affidavit, wherein it was inter alia averred that no case has been registered against the alleged detenu, and that he is not wanted or suspected in any of the pending cases of Chirala II Town Police Station. It is further averred that the police of the said police station have not taken into custody the alleged detenu either on 03.03.2017 or any other subsequent date, as he is not required in any case. Though the counter affidavit was filed as far back as 13.03.2017, no reply affidavit was filed by the petitioner contraverting the contents therein. There is no representation for the petitioner.
Having regard to the above noted averments, contained in the counter affidavit, the petitioner failed to make out any case. Hence, the Writ Petition is dismissed.
