HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24168 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader.

2. The case of the petitioner is that the land to an extent of Ac.171 cents in Survey No.169/1 of Rolugunta Village & Mandal, Visakhapatnam District belongs to their family. The Government acquired an extent of Ac.0-86 cents of land out of Ac.1-71 cents for the purpose of construction of Marshall Stone crusher in the year 1986. However, as the Government could not run the same, the Stone crusher was dismantled. As the purpose for which the land was acquired is not served and the land is not being used by the Government and kept fallow, the father of the petitioner made an application dated 08.01.2007 seeking the Government either to lease or sell the land to their family by fixing the market rate. After the death of his father, petitioner filed applications seeking either to lease or sell the land to an extent of Ac.0-86 cents acquired by the Government by fixing the market value. Questioning the inaction on the part of the respondents in considering the applications filed by the petitioner, the present writ petition is filed.

Having regard to the facts and circumstances of the case, I deem it appropriate to dispose of the writ petition directing the respondents to consider the application filed by the petitioner and pass appropriate orders in accordance with law. With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
