HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.12874 of 2011 ORDER:
The relief sought for in this Writ Petition is to direct the Revenue Divisional Officer to de-notify the lands of the petitioners in different survey numbers of Dopperla village and Survey No.102 of A. Somavaram village in Atchuthapuram Mandal in Visakhapatnam District, from the list of the lands prohibited from registration under Section 22-A of the Registration Act.
At the stage of admission, an interim order was passed on 15.07.2011 directing the Revenue Divisional Officer to take a suitable and appropriate decision pursuant to the report submitted by the Tahsildar, Atchutapuram in R.C. No.383/10/B, dated 18.11.2010; communicate the same to the petitioners herein as well as the SubRegistrar, Yelamanchili under whose jurisdiction the lands fall; and a decision to be taken within a maximum period of three weeks from the date of receipt of the order.
While Sri N. Ashwani Kumar, Learned Counsel for the petitioners, expresses ignorance as to what transpired thereafter, it is evident that the cause in the Writ Petition does not survive. If, in terms of the interim order, an order was passed in the petitioners favour, he would no longer be aggrieved. Conversely, if any order had been passed against the petitioner, he would then be required to question the validity of such an order. In either event, in view of the earlier interim order dated 15.07.2011, the cause in the Writ Petition does not survive necessitating any further adjudication by this Court.
