This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioner, who is arrayed as Accused No.6 in the event of his arrest in Crime No.773 of 2022 on the file of Station House Officer, Uppal Police Station, Rachakonda registered for the offences punishable under Sections 420, 467, 468 and 506 read with Section 34 of Indian Penal Code.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that he signed as a witness in the documents allegedly fabricated by Accused Nos.1, 3 and 4. The police arrested Accused Nos.1 to 5 who were remanded to judicial custody and released on bail.

In the said circumstances, since the allegation against this petitioner is that he was the signatory as a witness to the document, the prayer for anticipatory bail can be considered.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.6 is granted anticipatory bail subject to the following terms and conditions:

i) The petitioner/Accused No.6 is directed to surrender before the Station House Officer, Uppal Police Station, Rachakonda within one week from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioner/Accused No.6 shall appear before the concerned Station House Officer on every Monday and Thursday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or till filing of charge sheet whoever is earlier. iii) The petitioner/Accused No.6 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
