Heard learned counsel for the petitioner, learned Government Pleader for Roads & Buildings for respondents 1, 3 to 5, learned Government Pleader for Municipal Administration for respondent No.2 and Sri N.Praveen Kumar, learned Standing Counsel for Respondent No.6.

Petitioner claims that his father was the owner of house bearing No.6-1-108/12/1, constructed on 216 Square yards of plot at Three shops Center via Shanigapuram, Thorrur Road, Mahbubabad District. This writ petition is instituted alleging that the respondent-Municipality is trying to dispossess the petitioner and demolish the structures and take possession of the property belonging to him, without following due process and the same is illegal.

Learned Standing counsel, on instructions, submits that the Municipality is now taking steps to widen the road in the concerned stretch, where the house of the petitioner is situated, which is having different extents of width. The Municipality is now making assessment of land required, to have proper widening of road and in that process, the properties are being identified. He further submits that the matter is at the initial stage of exercise and once the issue is finalized, appropriate steps will be taken before dispossessing any person from the private property owned by such person.

According to learned Standing counsel, for the present the basic exercise of identifying the owners by verifying the documents is under process.

Having regard to the above submissions, the Writ Petition is disposed of. The respondents shall not demolish the subject property and petitioner shall not be dispossessed from the property without following due process, if the property of petitioner is required for public purpose. Pending miscellaneous petitions, if any, shall stand closed.
