THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.16064 of 2017 ORDER:

Petitioner is a Driver. He was assigned duty on 05.04.2017. It appears, he was checked through Breath Analyzer at Tekkali Depot. On the basis of the report of Breath Analyzer, by order, dated 10.04.2017, petitioner is placed under suspension. Learned counsel for petitioner submits that allegation levelled against petitioner is false and there is no occasion for him to consume alcohol and when he attended the duty at Tekkali Depot, nothing was proved and by the time he reached Visakhapatnam, it could not have happened.

At this stage, learned counsel for petitioner seeks leave of this Court to prefer appeal to the higher authority ventilating his grievance. If such appeal is filed, the appellate authority shall examine the grievance of petitioner and desirability of continuing the suspension and pass appropriate orders as warranted by law, within a period of two weeks from the date of receipt of such appeal.

Writ Petition is accordingly disposed of.

Pending miscellaneous applications, if any, shall stand closed in consequence.
