THE HON'BLE SRI JUSTI CE A.V.SESHA SAI C.R.P.No.5574 of 2016 ORDER:

The grievance in the present revision is non-disposal of I.A.No.580 of 2015 filed by the petitioners herein in O.S.No.94 of 2015 on the file of the Court of Senior Civil Judge, Penukonda.

The petitioners herein instituted O.S.No.94 of 2015 on the file of the said Court on 14.9.2015 for declaration of title and cancellation of registered sale deeds executed by 4th defendant in favour of defendants 5 and 6 dated 18.8.2015. Along with the said suit, the petitioners herein also filed I.A.No.580 of 2015 under the provisions of Order 39 Rules 1 and 2 of Code of Civil Procedure for interim injunction, restraining the defendants/respondents from changing the nature of petition schedule property by making constructions. 3.

In the said Interlocutory Application, according to the docket proceedings filed along with the CRP, the respondents herein already filed counters. It is the contention of the learned counsel for the petitioners that the said docket proceedings would itself indicate that the matter underwent several adjournments, but no final orders have been passed so far, despite filing counters by the respondents, which is causing hardship to the petitioners herein. 4.

Having regard to the submission made by the learned counsel for the petitioners and taking into consideration the material available before this Court, this Court is of the considered opinion that ends of justice would be served if the learned Senior Civil Judge, Penukonda is directed to dispose of I.A.No.580 of 2015 by fixing some time frame after giving opportunity to all the stakeholders.

For the aforesaid reasons, the CRP is disposed of, directing the learned Senior Civil Judge, Penukonda to dispose of I.ANo.580 of 2015 in O.S.No.94 of 2015 as expeditiously as possible, preferably within a period of four weeks from the date of receipt of this order, after hearing all the stakeholders. As a sequel, the Miscellaneous Petitions, if any, shall stand closed. There shall be no order as to costs.
