None appears for the petitioner. There is no representation on behalf of the petitioner when the matter is taken up.

The petitioner herein sought for quashing Crime No.119 of 2012 pending with the Mahila Police Station, Vijayawada City, Krishna District, registered for the offence under Sections 498-A, 494 and 506 of the Indian Penal Code. The 2nd respondent herein, who is the wife of the petitioner, is the complainant. The petitioner herein was married to the 2nd respondent nearly 22 years prior to the complaint being lodged. At that point of time, the petitioner appears to be working as an Assistant Commandant with the Special Police Force at Karimnagar. The 2nd respondent wife herein was living, at that time, at Hyderabad.

It is alleged by the 2nd respondent wife that the husband petitioner has developed illegal intimacy with another lady by name Hymavathi and when she confronted the petitioner, she has been subjected to an assault and has been necked out of the home. Therefore, she moved away to Vijayawada and started living there. It is the specific case of the complainant that the petitioner herein has married the said Hymavathi also at Sri Venkateswara Swamy Temple, Jaggaiahpet, Krishna District, on 27-07-2012. Smt. Hymavathi was the wife of Sri Gollaprolu Srinivasa Rao, who worked as a Reserve Inspector of Police and died. Hence, the 2nd respondent wife lodged the complaint with the police.

Since, a prima facie case is made out, I do not see any warrant for quashing Crime No.119 of 2012 pending with the Mahila Police Station, Vijayawada City, Krishna District.
