THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8252 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in connection with Crime No.129 of 2022 of Wankidi Police Station, KBM Asifabad District, for the offences punishable under Section 417, 420 and 376 of of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the petitioner is that he had committed rape on the defacto complainant, multiple times at her residence. 4.

According to the complaint the alleged rape was on 21.07.2022. However, the complaint was filed on 01.08.2022. No reasons are stated in the complaint regarding the delay in lodging the complaint.

Learned Counsel for the petitioner submits that the petitioner has been falsely implicated and there are several other cases

pending against the defacto complainant for being in possession of fake currency.

However, keeping in view the delay in lodging the complaint, the petitioner can be granted the relief of regular bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Principal Sessions Judge at Asifabad.

ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer, on every Monday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 21.09.2022 tk
