JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This civil miscellaneous appeal arises out of the order, dated 13.07.2007, in I.A.No.1428 of 2006 in O.S.No.183 of 2006 on the file of IV Additional District and Sessions Judge, Visakhapatnam.

2. At the hearing, no one represented for the parties. The office submitted a note, dated 15.07.2016, wherein it is stated that on verification from the Court below on the status of the aforementioned suit, in which the aforementioned I.A. was filed and the order in which is questioned in this appeal, it was informed that the said suit itself was dismissed on 20.12.2007 as settled out of Court.

3. As the very suit pending which this appeal is filed against the order passed in the interlocutory application filed in the said suit was dismissed as settled out of Court, this appeal has become infructuous and the same is, accordingly, dismissed as such.

4. As a sequel to dismissal of the appeal, C.M.A.M.P.No.1688 of 2007 filed by the appellant for interim relief shall stand dismissed as infructuous.
