THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.31828 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the Respondents herein in not granting leasehold rights by way of extension for quarry of ordinary sand in reach No. 5(a) of Oleru Village Limits of Bhattiprolu Mandal, Guntur District by considering the representations of the Petitioner dated 31.7.2015, as arbitrary, illegal, contrary to the APMMC Rules, 1966 and consequently direct the Respondents to grant leasehold rights by way of extension for quarry of ordinary sand for a quantity of about 18.500 cub. Meters in reach No. 5(a) of Oleru Village Limits of Bhattiprolu Mandal, Guntur District." Heard Sri Gaddam Srinivas, learned counsel for the petitioner and learned Government Pleaders for Mines and Geology and Revenue for respondents, apart from perusing the material available before this Court.

During the course of hearing it is submitted by the petitioner herein that for redressal of the grievance the petitioner herein submitted a representation on 31-07-2015 to the District Collector, Guntur District - 2nd respondent herein and no orders have been passed on the said representation. On the contrary, it is vehemently contended by the learned Government Pleaders for Mines and Geology and Revenue that the petitioner herein is not entitled for any relief in view of the instructions of the State Government on the issue.

There is no dispute with regard to the factum of pendency of representation before the 2nd respondent as on date and no orders have been passed on the same.

In view of the above reasons, the writ petition is disposed of, without

expressing any opinion on the merits of the matter, directing the 2nd respondent herein to pass appropriate orders on the representation, dated 31-07-2015 said to have been submitted by the petitioner herein strictly, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.
