THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.557 of 2017 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to grant prearrest bail to the petitioners/A.1 and A.2, who are apprehending arrest in connection with Cr.No.21 of 2017 of Dornakal Police Station, Warangal District, Telangana State, registered for the offence punishable under Sections 498-A of Indian Penal Code, 1860 (for short 'I.P.C.') and Sections 3 and 4 of Dowry Prohibition Act, 1961. After arguing the matter for a while, learned counsel for the petitioners seeks a direction from this Court to permit the petitioners to surrender before the Magistrate having jurisdiction over the area and move an application for grant of bail, which shall be decided on the same day.

Acceding to the request of learned counsel for the petitioners, I deem it appropriate to permit the petitioners to surrender before the Magistrate having jurisdiction over area and move an application for grant of bail, in which event, the Magistrate is directed to decide the same on the same day, after serving notice to the Public Prosecutor.
