HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 In/and CRIMINAL PETITION No.8377 of 2019 ORDER:

1) The petitioners filed this Criminal Petition under Section 482 Cr.P.C. to quash Crime No.213 of 2019 on the file of Women Police Station, Chariminar, Hyderabad, registered for the offences punishable under Sections 498-A, 406 and 506 IPC and Sections 4 and 6 of the Dowry Prohibition Act.

2) During pendency of the Criminal Petition, I.A.Nos.2 and 3 of 2019 came to be filed by the second respondent/ de facto complainant to accord permission to compromise and to record compromise, respectively. Along with the petitions, a joint memo came to be filed, inter alia, stating that at the intervention of elders and well wishers, the parties have amicably settled their disputes in terms of the compromise. The said joint memo has been duly signed by the parties and their signatures are duly attested/verified by their respective counsel. The said joint memo has been supported by the affidavit of the second respondent/ de facto complainant.

3) The petitioners filed Memorandum of Understanding dated 08.11.2019, as per which, petitioner No.1 agreed to pay a sum of Rs.12 lakhs to respondent No.2/ de facto complainant towards full and final settlement of all the claims of respondent No.2 and her minor daughter. As per the said Memorandum of Understanding,

today, before this Court, petitioner No.1 has given a Bankers Cheque dated 19.11.2019 for Rs.12 lakhs drawn on State Bank of India and respondent No.2/ de facto complainant acknowledges to have received the same.

4) Today, both the parties are present before this Court and they are identified by their respective counsel. Both the parties also produced their respective photographs and photostat copies of their Aadhar cards. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the aforesaid F.I.R. against the petitioners. 5) In the light of the compromise arrived at between the parties, the Memorandum of Understanding dated 08.11.2019 and the joint memo filed by both the parties are made part of record and I.A.Nos.2 and 3 of 2019 are ordered.

6) Accordingly, the Criminal Petition is allowed in terms of the joint memo, and Crime No.213 of 2019 on the file of Women Police Station, Charminar, Hyderabad, registered against the present petitioners is hereby quashed.
