THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8251 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in connection with Crime No.568 of 2022 of Mallardevpally Police Station, Cyberabad, for the offences punishable under Sections 376(2)(f)(n), 376(3) of the Indian Penal Code and Section5(l) 5(m) read with 6 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The petitioner was arrested on the allegation of committing rape on the victim girl who is a minor. The petitioner was remanded to judicial custody on 29.07.2022. The family of the victim i.e. her parents have approached the Sessions Court and stated that they have no objection for grant of bail to this petitioner. Accordingly, the Mother and the Victim girl also appeared before this Court, today. 4.

Learned Assistant Public Prosecutor on examination and verification of their particulars from their Aadhar Cards, identified

them. The photo copies of the Aadhar Cards are also placed on record.

When the victim girl and her mother refused to acknowledge the allegations against this petitioner, this Court feels appropriate to grant relief of regular bail to this petitioner subject to the following conditions.

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties for a like sum each to the satisfaction of XV Additional Metropolitan Magistrate, Cyberabad at Rajendranagar.

ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer, on every Monday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 21.09.2022 tk
