The petitioner, who is A.1, preferred the present Criminal Petition under Section 438 of the Code of Criminal Procedure, 1973, seeking release in the event of his arrest in connection with Crime No.314 of 2016 of Alwal Police Station, Cyberabad, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.

The case of the prosecution is that the informant lodged a report on 23.07.2016 stating that on 21.08.2008 she married the petitioner and lived happily for one year. Thereafter, the petitioner started harassing the informant physically and mentally. When the informant questioned his attitude, the petitioner and his mother demanded her to bring additional dowry of Rs.3,00,000/- from her parents. Basing on these allegations, the present crime came to be registered.

Learned counsel for the petitioner mainly submits that the allegations in the report are all false and invented for the purpose of this case. He further submits that A.2 was granted anticipatory bail and as the petitioner also stands on the same footing, his request may also be considered.

Learned Additional Public Prosecutor opposed the petition.

The averments in the report would show that the marriage of the petitioner with the informant was performed on 21.08.2008. One year after the marriage, the petitioner started suspecting the fidelity of the informant and used to find fault with her. It is further alleged that the petitioner and his mother are alleged to have demanded the informant to get a sum of Rs.3,00,000/- towards additional dowry.

Having regard to the nature of allegations, the petitioner shall surrender before the concerned Court and move an application for bail after giving prior notice to the learned Public Prosecutor, in which event, the same shall be considered at the earliest on such conditions as the Court deems fit.
