THE HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.28205 OF 2019 ORDER:

This Writ Petition is filed to declare the action of respondent No.2 in not investigating into the FIR No.356 of 2018 dated 10.11.2018, as being arbitrary, illegal and unconstitutional.

Heard Sri Mohd. Islamuddin Ansari, learned Counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions dated 23.12.2019, submits that based on the complaint made by the petitioner, the 3rd respondent authority registered a case in Crime No.356 of 2018 and took up investigation. In the course of investigation, L.Ws-1 to 8 were examined and those statements were recorded. The investigation done, revealed that the accused have attacked the complainant, pelted stones and caused injuries to L.Ws-1 to 4.

Learned Assistant Government Pleader for Home also submits that the authorities have issued notice under Section 41-A Cr.P.C. to accused Nos.1, 4 to 8 on 04.10.2019. By the said written instructions, it is also stated that investigation in the case is completed, except serving notice under Section 41-

A Cr.P.C. to the remaining accused. It is also further stated that final report in the above crime will be filed within one week.

Having regard to the said statement made on behalf of the 2nd respondent, no further orders are necessary in the matter.

Accordingly, the Writ Petition is closed. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
