Heard the counsel for petitioner, the learned Government Pleader for Civil Supplies (Telanagana) and the learned Government Pleader for Home (Telangana) for respondents.
2. The petitioner's vehicle bearing No.AP 21 TW 7529 was detained under a Panchanama dt.09.08.2015 by 4th respondent on the ground that it was being used for transporting subsidy PDS rice illegally.
3. The counsel for petitioner submits that petitioner has nothing to do with the said transportation and that if the vehicle is allowed to be retained by 4th respondent, it would get damaged. He further states that the vehicle be released to petitioner subject to petitioner furnishing a bank guarantee for the value of the said vehicle as assessed by the Joint Collector, Kurnool, Kurnool District (i.e., 2nd respondent).
4. The learned Government Pleader for Civil Supplies and the learned Government Pleader for Home for respondents, are also agreeable for the release of vehicle to petitioner subject to the condition of petitioner furnishing a bank guarantee for its value as assessed by the Joint Collector, Kurnool, Kurnool District.
5. In this view of the matter, the Writ Petition is disposed of directing 4th respondent to release the vehicle of petitioner on petitioner
furnishing a bank guarantee for its value as assessed by the Joint Collector, Kurnool, Kurnool District.
6. Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.
7. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
