HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7348 of 2016 ORDER:

This petition is filed by the petitioner/A-1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.4 of 2016 on the file of Y. Ramavaram Police Station, East Godavari District, registered for the offence punishable under Section 8(c) read with 20(b)(ii) of the NDPS Act.

Heard and perused the material available on record. It is alleged that the petitioner along with other accused were found in possession of 200 kgs of Ganja.

Learned Additional Public Prosecutor submitted that the earlier bail application of the petitioner was dismissed on 14.03.2016 and that there is no substantial change of circumstances. Considering the facts and circumstances of the case and the submissions of the learned Additional Public Prosecutor and since the ganja found in the above crime is commercial quantity, this Court is not inclined to grant bail to the petitioner.

Hence, the Criminal Petition is dismissed.
