This Writ Petition is filed seeking writ of mandamus declaring the action of the respondents in seeking to evict the petitioner from the land situated in Sy.No.309/87 to an extent of Acs.5.10 gts, situated at Romped Village of Yellandu Mandal of Bhadradri Kothagudem District in pursuant to orders passed by the 2nd respondent in LTR Case No.7/2017/Yld, dated 29.05.2018 pending before the 1st respondent on 30.06.2018 as illegal and arbitrary.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondents 1 and 2.

It is the case of the petitioner that eviction order is passed against petitioner by the 2nd respondent in LTR Case No.7/2017/Yld, dated 29.05.2018. Aggrieved by the same petitioner filed appeal along with stay petition before the 1st respondent on 30.06.2018 and that without passing any orders on the same, the respondents are trying to evict the petitioner. Aggrieved by the same, present Writ Petition is filed. Since it is stated that appeal along with stay petition is pending before the 1st respondent, without expressing any opinion on the merits of the case, the 1st respondent is directed to dispose of the appeal filed by the petitioner as expeditiously as possible, in accordance with law. Till disposal of the appeal, status quo

obtaining as today shall be maintained with regard to possession of the land.

With the above direction, this Writ Petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _________________________ A.RAJASHEKER REDDY, J 18-07-2018 kvs
