HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13581 of 2003 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioners submits that the 1st petitioner was challenging the orders dated 18.02.2002 passed by the 1st respondent-Labour Court in I.D.No.8 of 2000 wherein no relief was granted to him. The 1st petitioner was challenging the orders of removal before the Labour Court and he sought a direction in this writ petition to set aside the orders of removal and reinstate him into service. He further submits that the 1st petitioner has expired during pendency of the writ petition. Therefore, he contends that appropriate orders be passed directing the respondent corporation to pay the service benefits of the deceased 1st petitioner for the service rendered by him prior to his removal from service to his legal representative the 2nd petitioner.

Having considered the submission of the learned counsel for the petitioner, this Court is of the view that the writ petition can be disposed of directing the 2nd respondent corporation to pay the service benefits of the deceased 1st petitioner for the service rendered by him prior to his removal from service to his legal representative the 2nd petitioner, if not already paid, in accordance with the Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 15th December, 2018 cbs
