THE HON'BLE SMT. JUSTTCE P.MADHAVI DEVI CONTEMPT CASE No. L556 of 2o.22 ORDER:

The Contempt Case is filed alleging wilful and deliberate disobedience of the orders of this Court in W.P.No,7989 of 2O2l dated 29.03.2022 by the respondents and to punish the respondents for the sarne.

2. The petitioner alleged that in spite of the directions of this Court, the respondents have not complied with the directions of this Court.

3. After issuance of notice, the respondents have appeared and the Assistant Pay and Accounts Officer has been made as respondent No.4 suo moto by this Court.

4. Learned Government Pleader for Services-I appearing for respondent No.4, today has filed the details of the amount paid to the petitioner by three cheques i.e., two cheques dated 03.1I.2O22 and a cheque dated 2L.12.2O22. It is submitted that the said amount has been deposited I \ \ \ \ into bank account of the petitioner and stated that the --'\_ petitioner has also withdrawn the sarne.

5. Learned. counsel for the petitioner submits that the prayer in the Writ Petition was for revision of pension as rvell and since, the writ petition is allowed, the respondents are yet to comply with the said part of the orcler'

6. However, this court finds that in the last para of the order of this court, the direction was on15, to make payment for suspension period. within a period of 9O days from the date of receipt of the copy of the order. since, the said amount has already been paid, this Court does not find that there i-s any- wilful and delibe-rate- di bedience on the of the respondent in complying with the directions of this Court and any case for contempt. The peti.tioner is at liberty to pursue the remedy for revision of pension'

7. Accordingly, the contempt case is closed. There shall be no order as to costs.
