O R D E R

The grievance of the petitioner is that the 4th respondent who is the neighbour of the petitioner made constructions in deviation of the approved plan by the encroaching petitioner's property and blocking the public road from all four sides. Complaining about the same, the petitioner made several representations to the respondents and in pursuance to the same, the respondents issued notices to the 4th respondent under Section 452 and 636 of Greater Hyderabad Municipal Corporation Act, 1955 (for short 'the Act'). Thereafter, no subsequent action has been taken by the respondents. Aggrieved by the same, the present writ petition is filed.

Counter is filed by the 4th respondent stating that in pursuance to the notice issued by the respondents under Section 452 of the Act on 30.04.2012, he has filed explanation on 14.05.2012. But as on today, no orders are communicated to him with regard to the explanation filed by him.

Heard the learned counsel for the petitioner and Sri Chatla Madhu, learned Standing counsel for GHMC.

Since it is stated that no orders are passed in pursuant to the explanation filed by the 4th respondent on 14.05.2012, the 2nd respondent is directed to consider the explanation filed by the 4th respondent and thereafter take appropriate action in accordance with law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
