THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8265 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/A1 & A2 in connection with S.C.No.123 of 2022 on the file of I Additional District & Sessions Judge-cum-Special Judge for the trial of Cases under NDPS Act, Ranga Reddy District, which arose out of Cr.No.1025 of 2021 of Shadnagar Police Station, for the offences punishable under Section 20(b)(ii)(B) of the NDPS Act, 1985.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioners with another person were apprehended for being in possession of 50 Kgs of Ganja on 28.12.2021. The investigation is complete and the petitioners are in jail since the date of arrest.

Learned Assistant Public Prosecutor on instructions submits that there are no criminal antecedents against the petitioners and Accused No.3 was released on bail.

In the said circumstances, these petitioners can be granted the relief of regular bail subject to the following conditions: i) The petitioners/A1 & A2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of I Additional District and Sessions Judge-cum-Special Judge for the trial of Cases under NDPS Act, Ranga Reddy District. ii) The petitioners/A1 & A2, after release shall appear before the concerned Court, every day.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 21.09.2022 tk
