THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.14690 of 2017 ORDER: (per SK,J) The petitioner was impleaded as respondent No.7 in O.A.No.39 of 2017 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, by virtue of his implead petition in M.A.No.35 of 2017 filed in the said O.A. being ordered on 01.02.2017. The petitioner also filed V.M.A.No.21 of 2017 in the said O.A. to vacate the interim order dated 04.01.2017 passed therein.
Sri J.Sudheer, learned counsel for the petitioner, would state that though the said interim order was initially passed for a limited period, it was extended thereafter.
Learned Government Pleader would state that the authorities also filed a vacate miscellaneous application which is pending consideration. As the petitioner has already filed V.M.A.No.21 of 2017 in the O.A. pending before the Tribunal, we are of the opinion that it is not open to him to maintain this writ petition without first pursuing the same. The writ petition is accordingly dismissed on this short ground leaving it open to the petitioner to make suitable efforts before the Tribunal for seeking disposal of V.M.A.No.21 of 2017 filed by him in O.A.No.39 of 2017 expeditiously.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
