THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.8996 of 2007 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon'ble Court may be pleased to issue a writ, or direction more particularly one in the nature of writ of mandamus directing the Respondent No.1 Corporation to take suitable steps for not collecting 'Aseel' tax by the Respondent No.2 from the petitioner and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'
By order dated 26.04.2007, this Court directed the Municipal Corporation, Vijayawada, to keep the record of goods being moved into the area on each day and observed that the petitioner should undertake to pay the amount in the event the writ petition is decided against him. While so, it is now represented by Sri K.Manikanteswara Rao, learned counsel representing Sri T.S.Venkata Ramana, learned counsel for the Vijayawada Municipal Corporation, that the Corporation has taken a policy decision not to collect 'Aseel' tax from April, 2010 onwards. Learned counsel further states that in the light of this policy decision, no steps would be taken to collect 'Aseel' tax from the petitioner even for the period anterior to April, 2010.
Recording the said statement, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
