ORDER:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.1 in insisting respondent No.2 for issuing letter No.D1/2372/2009, dated 16.6.2009, for recovery of Rs.1.19 crores from the petitioner, and not allowing the petitioner to sell the properties as mentioned in letter, dated 16.9.2009, as illegal and arbitrary. After arguing the case, Mr. M.S.Prasad, learned senior counsel representing Mr. Khaja Shamshuddin Gazi, learned counsel for the petitioner, submitted that as

the Writ Petition is not properly framed, his client may be permitted to withdraw the same with liberty to him to avail a fresh remedy if he is so advised.

The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, WPMP.No.9898 of 2015 shall stand dismissed as infructuous.
