This Criminal Petition is filed under Section 438 Cr.P.C., by the petitioners/A.1 & A.2 to release them in the event of their arrest in connection with Crime No.2 of 2017 of Kondapuram Police Station, SPSR Nellore District, registered for the offences punishable under Sections 447, 427 read with 34 IPC, and Section 3(1)(r)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015, apprehending their arrest.

After arguing the matter for a while, learned counsel for the petitioners requested the Court to permit the petitioners to surrender before the Special Court for Trial of Cases under SCs/STs (POA) Act, Nellore, and file an application under Sections 437 and 439 Cr.P.C. for grant of bail and on such surrender, the learned Magistrate may be directed to decide the application on the same day. 3.

Acceding to the request of learned counsel for the petitioners, without touching the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Special Court for Trial of Cases under SCs/STs (POA) Act, Nellore and on such surrender, the learned Judge is requested to decide the application for bail, if any, filed under Sections 437 and 439 Cr.P.C., after serving notice on the learned Public Prosecutor, on the same day.
