HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.1135 OF 2017 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to grant pre-arrest bail to the petitioners/A.1 and A.2 apprehending their arrest in connection with Cr.No.541 of 2016 of Mancherial Police Station, Adilabad District, for the offence punishable under Section 420 of Indian Penal Code, 1860 (for short 'I.P.C.').

After arguing the matter for a while, learned counsel for the petitioners, seeks a direction from this Court to permit the petitioners to surrender before the Additional Judicial Magistrate of First Class, Mancherial, Adilabad District, and to move an application under Sections 437 and 439 of Cr.P.C. to grant bail and also seeks a direction to the Magistrate to consider their application on the same day.

Acceding to the request of learned counsel for the petitioners, without going into the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Additional Judicial Magistrate of First Class, Mancherial, Adilabad District, and to move an application for grant of bail, after due service of notice to the Public Prosecutor. In which event, the

- 2 - MSM, J Crl.P. No.1135 of 2017 learned Magistrate is directed to decide the same on the same day in accordance with law.

Accordingly, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
