HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.11250 of 2013 ORDER:

The petitioner prays for the following relief :- " ..... to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 2nd and 3rd respondents in pressurizing the petitioner to sell the property of an extent 101.5 Sq.yards in 46th ward in Budhavarapet, Kurnool City, Kurnool District, to the 4th respondent as illegal, arbitrary, and one without jurisdiction and violation of Article 14 of constitution of India and consequently direct the respondents not to interfere with the liberty of the petitioner ...." I have perused the affidavit and this court is of the view that the affidavit no doubt does not refer to registration of a crime against the petitioner. The learned Assistant Government Pleader does not dispute the stand in the affidavit that no crime or offence is registered against the petitioner.

As the crime is not registered, this court is of the view that respondents 2 and 3 cannot summon or pressurise the petitioner to settle the civil dispute between the petitioner and respondent No.4. The writ petition is, accordingly, disposed of, directing the respondents 2 and 3 not to interfere in the civil dispute or personal disputes between the petitioner and respondent No.4. It is made clear that if a crime is registered against the petitioner or the presence of the petitioner is required, in a crime pending in III Town Police Station, Kurnool, respondents 2 and 3 can summon the petitioner, in accordance with law. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. ____________ S.V.BHATT, J Date: 21.04.
