K.Rami Reddy v. The State Of Andhra Pradesh,

2017-08-07A V Sesha Sai2 pages

THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26165 of 2017 ORDER:

Heard the learned counsel for the petitioners, the learned Government Pleader for Mines & Geology and the learned Government Pleader for Revenue.

When the matter is taken up it is submitted by the learned counsel for the petitioners that, for redressal of their grievance, the petitioners herein submitted representations to the respondents on 20.10.2014 and 19.07.2017 but no action has been taken so far and, due to the said inaction, the petitioners herein, who are farmers, are sustaining irreparable loss and injury. It is also stated in the affidavit, filed in support of the petition, that all the agricultural lands in and around the quarry became barren lands and one of the farmers namely Sri Ramakoti Reddy, due to heavy loss, went to the extent of attempting to commit suicide and, if the respondents do not intervene in the matter and stop the mining operations, manifest injustice would be caused to the petitioners herein. This Court is of the considered opinion that the ends of justice would be met if the Writ Petition is disposed of directing the respondents herein to take appropriate action on the representations dated 20.10.2014 and 19.07.2017, said to have

been submitted by the petitioners herein, in accordance with law after giving notice to all the stakeholders.

The Writ Petition is, accordingly, disposed of.

Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
