THE HON'BLE SRI JUSTI CE S.V.BHATT WRI T PETI TI ON No.29640 OF 2013 ORDER:

Petitioner complains against respondents 1 to 3 in not disposing of the complaint/representation dated 07.07.2013 and not taking action by the 3rd respondent as illegal, arbitrary and unconstitutional.

Learned Assistant Government Pleader, on oral instructions from respondent No.3, states that as a matter of fact, no complaint or representation dated 07.07.2013 is received by the 3rd respondent, hence the inaction complaint is incorrect. He further submits that the petitioner, if re-submits the complaint dated 07.07.2013, the 3rd respondent is prepared to receive and act in accordance with law.

The statement is placed on record. I am satisfied. Accordingly, the Writ Petition is disposed of by the following Order:

(i) The petitioner is given liberty to file representation dated 07.07.2013 before the 3rd respondent within a period of four (04) weeks from the date of receipt of a copy of this order.

SVB,J WP_29640_2013 (ii) On receipt of such representation, the 3rd respondent is directed to act on the representation in accordance with law.
