THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10200 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.937 of 2023 on the file of Rajendranagar Police Station, Cyberabad, registered for the offence under Section 302 r/w. 34 of IPC. 2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that a complaint was lodged on 29.08.2023 alleging that the deceased was attacked in front of Celebrity Fitness Studio. The victim was taken to the hospital with grievous injuries where was declared dead. In the complaint, it is mentioned that four persons have attacked him with knives. On the basis of the said complaint, the Police identified this petitioner and seven others as responsible for causing the death of the deceased.

The petitioner is seeking bail mainly on the ground that his daughter's marriage is scheduled on 24.10.2023.

Learned Additional Public Prosecutor on instructions would submit that the marriage of petitioner's daughter is scheduled on the said date i.e., 24.10.2023.

In the circumstances stated above, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of XI Additional Metropolitan Magistrate, Cyberabad at Rajendranagar, Ranga Reddy District. ii) The petitioner/Accused No.3 after release shall appear before the concerned Station House Officer, on every alternate day at 10:00 a.m. for a period of three weeks for the purpose of investigation and thereafter, as and when required.
iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 7.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
