THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition Nos.13856, 3515, 3562 and 3805 of 2015 COMMON ORDER:
All these writ petitions are being disposed of by this common order, in view of the common cause of action that arose for consideration before this Court and with the consent of all parties. W.P.No.13856 of 2015 was filed challenging the action of the respondents in not restraining respondents 5 & 6 in converting their agricultural lands as fish ponds in an extent of 24 guntas in R.S.Nos.249, 250, 247, 251, 256, 142 and 143 situated at Gannavaram Village, Krishna District.
W.P.Nos.3515, 3562 & 3805 of 2015 were filed by the lessees including respondents 5 & 6 in W.P.No.13856 of 2015 seeking disposal of their applications for conversion of agricultural lands taken on lease as fish ponds, pursuant to G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department, dated 16.03.2013.
The allegation of the petitioners is that they submitted applications for conversion of their lands which were taken on lease way back on 05.02.2011 as fish ponds and even though their applications were recommended for consideration to the District Level Committee for registration of aquaculture, the District Level Committee has not taken any decision on the said applications. The learned counsel for the petitioner in W.P.No.13856 of 2015 submits that even without obtaining any prior permission, the petitioners in the above writ petitions are converting their agricultural lands for aquaculture purpose.
In the circumstances, the second respondent-District Level Committee for registration of aquaculture is directed to consider the applications of the petitioners in W.P.Nos.3515, 3562 & 3805 of 2015,
in accordance with G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (Fish.II) Department, dated 16.03.2013 and also the amendment made thereto, within a period of 60 days from the date of receipt of a copy of this order and also hear the petitioner in W.P.No.13856 of 2015 at the time of considering the applications of the petitioners in W.P.Nos.3515, 3562 & 3805 of 2015. Till the petitioners in W.P.Nos.3515, 3562 & 3805 of 2015 obtain necessary permission, they shall not convert their agricultural lands for aquaculture purpose. It is open to the official respondents to take necessary action in case the petitioners in W.P.Nos.3515, 3562 & 3805 of 2015 convert their lands without obtaining any prior permission.
With the above directions, these writ petitions are disposed of. Miscellaneous Petitions, if any pending in these writ petitions shall stand closed. No order as to costs.
