THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5770 of 2017 ORDER:

This criminal petition is filed by the petitioner-accused, under Section 438 of Cr.P.C., seeking pre arrest bail in Crime No.12 of 2017 on the file of the Station House Officer, Amarchintha Police Station, Wanaparthy.

Heard the learned counsel for the petitioner. The learned Additional Public Prosecutor representing the State opposed the bail petition.

The case of the prosecution is that the petitioner developed illicit intimacy with the wife of one Palvari Sridhar (hereinafter referred to as, the deceased). In that connection, about three months back, a Panchayat was conducted and the elders admonished the petitioner to disconnect his relation with the wife of deceased and not to go towards the house of the deceased. It is the further case of the prosecution that the petitioner picked up quarrel with Sridhar and scolded him for which he had become upset and committed suicide. Basing on the statement given by the deceased, in Government Hospital, Athmakur, the present case was registered.

The petitioner filed Crl.M.P. No.632 of 2017 on the file of the Court of III Additional District and Sessions Judge, Gadwal, under Section 438 of Cr.P.C., and the same was dismissed on 28.6.2017 on the ground that the investigation is pending.

A perusal of the record prima facie reveals the role played by the petitioner. As submitted by the learned Additional Public Prosecutor, the investigation is in progress. 6.

Having regard to the facts and circumstances of the case, this court is of the considered view that it is not a fit case to grant anticipatory bail to the petitioner.
