THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.307 of 2010 ORDER:

Heard the learned counsel for petitioner, the learned Government Pleader for Social Welfare for respondents 1 to 3 and the learned Standing Counsel for respondents 4 and 5.

2. Petitioner is the legal heir of one Balraj, who was working as an Attender in the fourth respondent school and died on 19.11.2007 in the school premises. The petitioner sought appointment on compassionate grounds by his representation dated 15.09.2008. It was followed by a notice dated 29.11.2008 sent through his Advocate. A reply was given by the third respondent on 29.11.2008 informing the petitioner that the Government Orders are not applicable to it. Challenging the said proceedings dated 29.11.2008, the present writ petition was filed.

A counter was filed by the third respondent stating that the scheme for compassionate appointment to the dependants of the deceased employees working in the State Level Public Enterprises has been dispensed by the Government, by G.O.Ms.No.36, dated 05.09.2001, and only an ex-gratia payment in lieu of compassionate appointment was ordered in the said GO. Accordingly, an amount of Rs.50,000/- towards ex-gratia was sanctioned by the Executive Engineer, Medak District Scheduled Caste Service Cooperative Society Limited, Medak at Sangareddy vide proceedings dated 29.03.2008 and the said amount was paid to the dependant of the deceased employee.

4. In view of G.O.Ms.No.36, dated 05.09.2001 and in view of receipt of ex-gratia amount by the wife of the deceased employee, the petitioner cannot claim any right for compassionate appointment and hence the relief sought in the writ petition cannot be granted.

5. The writ petition is, accordingly, dismissed. No order as to costs.
