HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.31896 OF 2014 ORDER:

The petitioner challenges proceedings D/1006/2014 dated 17.09.2014 issued by 3rd respondent suspending the authorization of petitioner pending finalization of disciplinary proceedings. On 24.10.2014, the proceedings dated 17.09.2014 was suspended by this court. The Assistant Government Pleader placed on record the proceedings dated 22.12.2014 issued by the 3rd respondent whereunder the 3rd respondent had implemented interim order passed by this Court. From the above, it is clear pursuant to order of this Court dated 24.10.2014, the proceeding dated 17.09.2014 is stayed and petitioner is distributing essential commodities as fair price shop dealer.

The writ petition is disposed of by placing the above circumstances on record and the interim order is made as final order in the writ petition.

It is needless to observe that if the respondents intend or the circumstances warrant the disciplinary enquiry initiated against the petitioner to be brought to its logical end, they can proceed, however, by following the procedure stipulated by law. Miscellaneous petitions pending, if any, in the writ petition shall stand closed.
