HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 27202 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Kondareddipalem village, Kaligiri Revenue Mandal, SPSR Nellore District. It appears that the Deputy Tahsildar (Civil Supplies) of Kaligiri mandal inspected the fair price shop of the petitioner on 7.7.2015 and noticed some irregularities. He submitted a report on 10.7.2015, based on which, the second respondent suspended the authorization of the petitioner by order dated 22.7.2015. A show case notice was also issued on the same day. Challenging the suspension of authorization, the petitioner filed the present Writ Petition.

As many as six charges are levelled against the petitioner and a perusal of the said charges it is manifestly clear that conduct of enquiry by the second respondent is inevitable. Inasmuch as the petitioner has already submitted his explanation on 29.7.2015, this Court is not inclined to go into the merits or otherwise of the subject matter at this stage. Having regard to these facts and circumstances of the case, the second respondent is directed to conduct an enquiry in respect of the irregularities levelled against the petitioner by duly furnishing a copy of the report of the Deputy Tahsildar (Civil Supplies), Kaligiri Mandal, dated 10.07.2015 and affording an opportunity to the petitioner and thereafter pass final order

within a period of thirty days from the date of receipt of a coy of this order.

Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
