HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.668 of 2015 ORDER:

This petition is filed to withdraw divorce O.P.No.224 of 2015 from the file of Principal District Judge, Krishna at Machilipatnam, and transfer the same to Judge, Family Court, Hyderabad.

2. Wife filed this petition and according to her affidavit, after the marriage she noticed that respondent had past conduct and apprehended life threat in the hands of respondent and his relatives because of bad vices of the respondent and that she is staying with her parents at Hyderabad. She stated that respondent filed divorce O.P.No.224 of 2015 on the file of Principal District Judge, Machilipatnam, with false and untenable allegations and it is difficult for her to travel all the way from Hyderabad to Machilipatnam and prayed for transfer of O.P. from Machilipatnam to Family Court, Hyderabad.

3. Respondent filed counter disputing the affidavit averments of petitioner.

Advocate for respondent submitted that respndent is a small employee working at Vijayawada and it is difficult for him to travel from Vijayawada to Hyderabad by spending travel expenses.

4. Heard both sides.

5. Considering the submissions of both sides and affidavit and counter affidavit of both parties, I am of the

view that divorce O.P. pending on the file of Principal District Judge, Machilipatnam, Krishna District, can be withdrawn and transferred to Family Court, Hyderabad, for the convenience of wife by dispensing with the presence of husband for each and every adjournment before Family Court, Hyderabad.

6. Accordingly, divorce O.P.No.224 of 2015 is withdrawn from Principal District Judge, Machilipatnam, and transferred to Family Court, C i t y Civil Court, Hyderabad, for disposal in accordance with law. Family Court, City Civil Court, Hyderabad, shall dispense with the presence of husband for each and every adjournment. However, he shall appear as and when his physical presence is felt necessary for any specific purpose.

7. Accordingly, transfer C.M.P. is ordered.

8. Miscellaneous petitions pending, if any, shall stand closed.
