Aggrieved by the action of the 2nd respondent in issuing notice in Rc.No.773/2014/C4, dated 13.07.2018, without hearing the petitioner, this Writ Petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for respondent No.1.
In this case, it is to be seen that the petitioner challenges notice in Rc.No.773/2014/C4, dated 13.07.2018 along with the findings of District Level Scrutiny Committee, Guntur, in which petitioner was asked to show-cause as to why his Caste Certificate could not be cancelled.
It is not the case of the petitioner that the authority, who issued impugned show-cause notice lack any jurisdiction. Normally, this Court will not interfere at the stage of show-cause notice, unless the same is without jurisdiction. Since the jurisdictional aspect is not raised in this writ petition, it is open for the petitioner to raise all the objections, including the findings of the District Level Scrutiny Committee before the concerned authority-2nd respondent and the 2nd respondent is directed to consider, after taking all the objections raised by the petitioner into account and pass orders, after affording an opportunity of hearing to the petitioner.
With the above direction, this Writ Petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _________________________ A.RAJASHEKER REDDY, J 18-07-2018 kvs
