Today, when the matter is called, on instructions, it is submitted by the learned Standing Counsel for Respondent Corporation Smt.Pingle Lakshmi that notices under Section 452(1) and 461(1) of HMC Act, 1955 dated 23.6.2018 and notice under Section 452(2) of HMC Act dated 10.7.2018 were issued in the name of a dead person and as such, the Respondent Corporation may be permitted to issue notices afresh in the name of the petitioners. Recording the said submission, the writ petition is allowed, setting aside the Notice No.UC/656/TPBO/EWARD:9/CIRCLE:7/GWMC/2018 dated 23.6.2018 and Notice No.UC/656/TPBO/EWARD:9/CIRCLE:7/GWMC/2018 dated 10.7.2018 issued by the Respondent Corporation. However, it is open for the Respondent Corporation to issue notices afresh and to proceed in accordance with law. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
