THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21087 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare.

With the consent of both parties, the writ petition is disposed of at the admission stage.

Since this Court is not adjudicating the matter on merits, it may not be necessary to issue notice to respondent No.3. The present writ petition is filed with the following prayer: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that the Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction on the part of respondent No.2 in taking action against respondent No.3 pursuant to the representation given by the petitioner dated 10.06.2016 as illegal, arbitrary, in violation of the Wakf Act and amounts to dereliction of duties. Consequently, this Hon'ble Court may be pleased to direct respondent No.2 to take action against respondent No.3 pursuant to the representation given by the petitioner dated 10.06.

2016 and put the petitioner in peaceful possession of a registered Wakf property by name Majid E Munawara, on land under Survey No.737/1, admeasuring 445 square yards, situated at Beerappagadda, Uppal Mandal, Ranga Reddy District, as its Mutawalli, pursuant to proceedings vide F.No.13/RR/Reg/2013, dated 12-12-2013, immediately and forthwith, and pass any other order or orders as deemed fit and proper in the circumstance of the case in the interest of justice.'

The grievance of the petitioner appears to be that though he lodged a complaint with regard to the functioning of respondent No.3 as Mutawali, no action has been initiated till date. Having regard to the circumstances stated above and taking into

consideration the facts in issue, the writ petition is disposed of directing respondent No.2 to take action in complaint dated 10.06.2016, made by the petitioner seeking action against respondent No.3, in accordance with law, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. It is needless to mention that before considering the representation, opportunity of personal hearing may be given to the petitioner and respondent No.3.
