HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9202 of 2017 ORDER:

The case of the petitioners is that originally the land admeasuring Ac.0.60 cents in Survey No.6/2, situated at Ainavolu Village, Tulluru Mandal, Guntur District, was purchased by their father under registered document bearing No.121/1959 for a valuable consideration and since then the property is in exclusive possession and enjoyment of the petitioner's father. After his demise, petitioners' brother and mother are in joint and exclusive possession and that the subject property has been gifted to them at the time of their marriage by their father. It is also stated that the 4th respondent is the cultivating tenant of the said property who with a malafide intention to grab the said property submitted fabricated, sham and illegal documents to the 3rd respondent for illegal gain and that the 3rd respondent is going to disburse the annuity amount and also going to allot plots to the 4th respondent, since the subject land was in purview of CRDA. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioners.

Learned Standing Counsel for the 3rd respondent submits that the petitioners are not having any land in Survey No.6/2; that the petitioners have not filed any objections before them; and that they have already paid annuity to respondents 4 and 5. He also submits that the petitioners without approaching the

authorities, have straight away filed the present writ petition. The same is not disputed by the learned counsel for the petitioner. In view of the above, this Court is not inclined to entertain this writ petition.

Accordingly, the writ petition is dismissed. However, it is open for the petitioners to make necessary objections before the 3rd respondent. If any objection is made the same may be considered in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 16.03.2017 t k.
