HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.160 of 2016 ORDER:

This petition is filed to withdraw O.P.No.442 of 2015 from the file of Family Court, Vijayawada, and transfer the same to Family Court, Secunderabad, to be tried along with O.P.no.623 of 2015.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 04.10.2009 at Nalgonda as per Hindu rites and custom and she is vexed with the attitude of respondent and she was necked out from the house on 15.08.2015 along with her children and as she had no other alternative, she went back to her parents house and husband filed O.P.No.442 of 2015 at Family Court, Vijayawada, for restitution of conjugal rights and filed another O.P.No.623 of 2015 for custody of the children before Family Court, Secunderabad, and she is now residing at Secunderabad and it is difficult for her to travel from Secunderabad to Vijayawada for defending O.P.No.442 of 2015 and as both the matters are to be tried by one Court, she prayed for transfer of O.P.No.442 of 2015 from Vijayawada to Secunderabad.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard arguments.

5. Considering the reasons stated in the affidavit,

O.P.No.442 of 2015 is withdrawn from Family Court, Vijayawada, and transferred to Family Court, Secunderabad, to be tried along with O.P.No.623 of 2015.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
