Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration & Urban Development for respondent No.1, Sri P.Sudheer Rao, learned Standing counsel for respondent No.2 and learned Government Pleader for Revenue for respondent No.3 2.
Petitioner claims to have filed objections against the voters list published by the Municipality concerning Ibrahimpatnam Municipality. The objections filed were rejected by the Municipal Commissioner, vide his letter dated 13.12.2019. 3.
From a reading of the order, it appears, that petitioner objected for inclusion of about 200 names in the voters list, stating that many of them are living 3 kms away from the Municipality and names of persons who have already died are also not excluded, therefore, they should be excluded and the voters list be confined to 980 voters only. The request was rejected on the ground that whatever the voters list is furnished by the Election Commission of India, is followed and if there is any name to be deleted from the said list, petitioner has to make application to the Electoral Registration Officer.

When the matter is taken up, learned counsel representing the State Election Commission, informs the Court that a revised schedule was published on 23.12.2019. In terms thereof, the draft photo electoral rolls of Municipality were published on 30.12.2019, granting time to file objections till 02.01.2020. Even with reference to updation of voters list, time is available till 07.01.2020. If there
- 3 - is any discrepancy in the voters list published by the Election Commission of India, the aggrieved person has to make application to the Electoral Registration Officer, and only if any decision is made by the Electoral Registration Officer, the same would be implemented by the State Election Commission. 5.
Having regard to these submissions, the Writ Petition is disposed of, granting liberty to the petitioner to raise objections on the draft photo electoral rolls stated to have been published on 30.12.2019. It is also open to the petitioner to make an application to the Electoral Registration Officer, pointing out the discrepancies in the electoral list and if such application is filed, the same shall be considered and appropriate decision be communicated to the State Election Commission and the petitioner.
