THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19862 of 2016 ORDER :

The present Writ Petition came to be filed seeking to issue writ of mandamus declaring the action of respondent No.4 in not proceeding with the investigation into crime No.344 of 2014 though it was registered on 07.10.2014, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. Pursuant to an order dated 28.08.2014 in Writ Petition No.20125 of 2014 directing respondent No.4 to register crime, finalize investigation and file final report, the fourth respondent herein registered a case in crime No.344 of 2014 for the offences punishable under Sections 448, 323, 363, 379, 506 read with 34 of the Indian Penal Code, 1860. Grievance of the petitioner is that though the crime was registered on 07.10.2014, till date, there is no progress in the investigation. The same is disputed by the learned Assistant Government Pleader

stating that the police are investigating into the matter and as soon as it is completed, they would file a final report.

4. Having regard to the circumstances of the case, respondent No.3 is directed to complete the investigation in the aforesaid crime and file a final report, in accordance with law, as early as possible preferably within a period of three months from the date of receipt of a copy of this order.

5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
