CVNR,J & TA, J C.M.A.No.472 of 2016 Date:22.11.2018 Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This civil miscellaneous appeal is filed against arbitral award dated 18.10.2014.

At the hearing, Mr.B.Mayur Reddy, learned counsel for the appellant, submitted that on an incorrect advice, the appellant has filed this appeal, instead of filing an application under Section 34 of the Arbitration and Conciliation Act, to set aside the arbitral award. He, accordingly, requested for permission to withdraw the appeal, with liberty to his client to avail appropriate legal remedies. 3.

The appeal is, accordingly, dismissed as withdrawn, with liberty to the appellant in terms of the prayer made. 4.

As a sequel to the dismissal of the appeal, I.A.No.1 of 2017 (CMAMP.No.1585 of 2017) and I.A.No.2 of 2016 (CMAMP.No.918 of 2016) stand disposed of as infructuous.
